for users of our service. Some of these guidelines may seem strict, but they ensure a
safe, functional, and trusted environment for our customers to publish their information
on the Web.
Many of our competitors do not require their customers to comply with these guidelines.
If any of our potential customers are unwilling or unable to comply with these guidelines,
we respectfully invite them to visit one of our competitors.
Domain Name Registration terms
a. We do not warrant or guarantee that the domain name applied for will be registered in your
name or is capable of being registered by you. Accordingly, you should take no action in
respectof your requested domain name(s) until you have been notified that your requested
domain namehas been registered.
b. Both the registration of the domain name and its ongoing use are subject to the relevant
namingauthority's terms and conditions of use and you are responsible for ensuring that you
are aware ofthose terms and conditions and can and do comply with them. You irrevocably waive
any claims youmay have against us in respect of the decision of a naming authority to refuse to
register a domain nameand, without limitation agree that the administration charge paid by you to
us shall be non-refundable inany event.
c. We accept no responsibility in respect of the use of a domain name by you and any dispute
betweenyou and any other individual or organisation regarding a domain name must be resolved
between theparties concerned and we will take no part in any such dispute. We reserve the right,
on our becomingaware of such a dispute, at our sole discretion and without giving any reason,
to either suspend or cancel the domain name, and/or to make appropriate representations to the
relevant naming authority.
Web and FTP Site Content Policies:
We do not allow any of the following content to be published on a Spirit Servers System:
Content of a pornographic, sexually explicit, adult nature.
Content of an illegal nature (including stolen copyrighted material).
Pirated software sites.
Hate sites or content that could be reasonably considered as slanderous or libellous.
Content that is questionable regarding any of the above criteria will be decided upon by a
Spirit Servers representative.
Users posting any of the above content on their sites will have their Web and/or incoming
anonymousFTP services temporarily suspended. They will then be contacted by Spirit Servers
and given theopportunity to remove the content in question before having their services reinstated.
A repeated offencemay cause cancellation of service without refund of any fees.
Email Usage Policies:
Spirit Servers does not support unsolicited email messages sent by users of our system (also
known as junk email or SPAM). Users sending unsolicited email messages from our system or
posting SPAM in Usenet Newsgroups will have all of their services temporarily suspended.
They will then be contacted by Spirit Servers and informed of the suspension before having their
services reinstated. A repeated offence may cause cancellation of service without refund of any fees
Illegal Activities:
Customers caught using our system for illegal activities, including but not limited to breaking in to
remote systems, credit card fraud, theft, vandalism, threats, or violence, will have their accounts
immediately cancelled without refund of any fees.
Right To Refuse Service:
Spirit Servers reserves the right to refuse service to anyone for any reason. We enforce this policy to
ensure a professional environment for the users of our system.
Privacy:
Spirit Servers supports the protection of personal data in the online environment.
Spirit Servers does not, and will not, sell, rent, loan, lease, trade or market personal information
about those who visit this web site or contact the Spirit Servers offices. Advertising is not sold
on the Spirit Servers web site.
Any individual or organization wishing to be on the Spirit Servers Updates mailing list can sign
up for it in the appropriate area on the web site. An area to ask for the removal of their name from
the mailing list is also provided.
